While rideshare companies are convenient, they are often criticized for failing to adequately regulate their drivers and for failing to do enough to protect passenger safety. Uber’s Annual Accident Report itself lists not only accident statistics, but also assault and sexual assault statistics. That paints a picture that, although slim, there are some real safety concerns when using rideshare programs.
Part of the safety issues with Uber and Lyft stem from their somewhat lax regulations for who can operate as a rideshare driver. For example, some of the only requirements to be an Uber driver are as follows:
- Be the minimum age to drive in your city;
- At least 1 year of driving experience (3 years if you are under 25);
- Have a clean driving record;
- Have an in-state driver’s license (depending on their state);
- Proof of residency and insurance;
- Pass a basic background check.
In fact, Uber’s website promotes the fact that people can “sign up in minutes” to be a driver. Lyft’s requirements are very similar, with the exception that they require their drivers to be at least 25 years old.
These limited restrictions do not guarantee that Lyft or Uber drivers will operate their vehicles in a safe manner. As such, rideshare accident claims are actually quite common from passengers who have suffered injuries while using one of these services. When accidents involving Uber or Lyft rideshare vehicles occur, the same rules and laws apply as with any other motor vehicle accident. In other words, the person or people that are liable for the crash is the person or people whose negligence caused the car wreck. If the accident was caused by the negligence of the Uber or Lyft driver then they will be liable if it was the other driver then they are to be held responsible. If both parties are partly at fault then both could be liable for the rideshare passenger’s resulting injuries.
Currently, the Nevada government requires Uber to provide $1.5 million in auto liability insurance when a passenger is getting a ride in an Uber and $50,000 in coverage if the driver is logged into the app but does not have a passenger. There was a bill SB125, proposed in 2023 which if turned into legislation would have required even more of Uber and its drivers, providing additional protection for passengers. It would have applied a common carrier designation to rideshare services in Nevada, the same classification that taxi services are under. It did not get enough votes to pass in April 2023.
According to Chapter 706 of Nevada Legislation, which controls the regulation and licensing of motor carriers, common carriers must exercise a higher level of care when it comes to the safety of their customers. More specifically, Uber and Lyft must show the same level of care as a “very cautious, competent, and prudent person under the same or similar circumstances.” This higher level of accountability means that rideshare drivers can also be partially liable for a passenger’s injuries if they were not driving carefully. Uber and Lyft drivers are also expected to provide proper care when dropping off and picking up passengers and can be held liable for injuries sustained by a passenger if they were not in the vehicle actively being driven somewhere.
