What Are Nevada’s Laws on Drunk Driving?
In Nevada, the legal blood alcohol concentration (BAC) limit for drivers over the age of 21 is 0.08%. For commercial drivers, the limit is lowered to 0.04%, and for drivers under 21, the limit drops further to 0.02%.
Driving with a BAC above these limits is considered illegal per se in Nevada. However, it's important to note that a driver may still be considered impaired and face DUI charges, even if their BAC is below the legal limit. If a responding officer determines that a driver is under the influence of alcohol and/or drugs, and they are unable to safely operate their vehicle, they may still be arrested and convicted of DUI. This applies even if the driver is below the legal BAC limit or impaired in other ways-whether they are DWI, high, drugged, stoned, buzzed, or distracted (such as texting while driving).
If a drunk driver was being served alcohol by a business, such as a bar, before they caused an accident, many states allow the people who were hurt to pursue a claim against the business as well as the drunk person. These laws, the ones that allow the injured party to recover from the business, are referred to as Nevada dram shop laws.
Unfortunately, Nevada has a law that effectively says the opposite. Under Nevada’s law, the injured person generally cannot recover for their damages/injuries from the business that served the alcohol.
More specifically, Nevada’s law, NRS 41.1305, states that a business that serves alcohol to a “person who is 21 years of age or older is not liable in a civil action for any damages caused by the person to whom the alcoholic beverage was served . . . .” Nevada’s law does have an exception for circumstances in which the alcohol was served to an underage person, someone under 21 years of age. However, even this exception has limitations.
