What Should You Do If You are Hit By A Drunk Driver?
If you were injured by a drunk driver, your health should be your top priority. Sometimes, the nature and extent of the injuries sustained in a car crash are not obvious. That, combined with the confusion and disorientation that usually follows a wreck, can make it difficult to know you need medical attention.
However, if you believe you may have sustained any injuries, even minor injuries, it is very important that you see a medical professional as soon as possible. Your injuries may be much more serious than they initially appear. Even if it has been several days since the drunk driver hit you, if you have not yet seen a doctor, you should consider doing so as soon as possible.
Letting a medical professional diagnose your injuries is the best way to understand their true extent and to ensure that you get any emergency medical care needed.
Like many of our clients, you may be worried about paying for the medical treatment you need. After all, even a minor medical issue can be very expensive. The driver who caused the crash, and possibly their insurance company, is responsible for your medical bills. However, they do not typically pay them as you go. But you may still be able to obtain the treatment you need for your injuries without paying for it out of your pocket – which sometimes requires the help of an experienced Las Vegas drunk driver accident lawyer.
Instead, people injured in a car wreck usually use a combination of their health insurance and liens to pay for any needed medical treatment. This allows people hurt in car accidents to get the treatment they need, including surgeries, without having to come out of pocket at the time of the treatment.
You can find more information on obtaining needed medical care after a crash by talking with a Las Vegas drunk driving accident lawyer here at SJW.

In Nevada, the legal blood and alcohol, or BAC, limit for drivers over the age of twenty-one is 0.08%. This limit drops down to 0.04% for commercial drivers and, even further, to 0.02% for those drivers under twenty-one.
Driving with a BAC that is over the limit is considered illegal per se in Nevada. Sometimes an impaired driver can be below the legal limit and still be considered too intoxicated to legally drive under Nevada law. If the responding officer determines that the other driver was under the influence of alcohol and/or drugs and, despite being under the legal limit was still not able to safely operate their vehicle, they may still be convicted of DUI. This is true whether the driver was DWI, high, drugged, stoned, impaired, buzzed, or otherwise distracted – like when texting and driving.
If a drunk driver was being served alcohol by a business, such as a bar, before they caused an accident, many states allow the people who were hurt to pursue a claim against the business as well as the drunk person. These laws, the ones that allow the injured party to recover from the business, are called “dram shop laws.”
Unfortunately, Nevada has a law that effectively says the opposite. Under Nevada’s law, the injured person generally cannot recover for their damages/injuries from the business that served the alcohol.
More specifically, Nevada’s law, NRS 41.1305, states that a business that serves alcohol to a “person who is 21 years of age or older is not liable in a civil action for any damages caused by the person to whom the alcoholic beverage was served . . . .” Nevada’s law does have an exception for circumstances in which the alcohol was served to an underage person, someone under 21 years of age. However, even this exception has limitations.
If you were hit by a drunk driver, you need an experienced injury firm to ensure you recover from all responsible parties. While Nevada’s laws restrict our ability to hold businesses responsible, your case may fall into one of the exceptions. If you were hurt by someone driving under the influence and have questions regarding who may be held responsible, give us a call today – the consultation is always free.
Sometimes when a person (or business) hurts or injures someone else, their behavior was so egregious that the law allows the injured person to recover additional compensation in order to punish the business and/or person who caused the injuries. These are called punitive damages. More specifically, punitive damages are monetary awards meant to punish wrongdoers who, among other things, engaged in acts disregarding the safety of others.
Nevada law allows people who were injured by a drunk driver to recover punitive damages. As NRS 42.010 states, people injured by a drunk driver “may recover damages for the sake of example and by way of punishing the defendant.”

What Are Nevada’s Laws on Drunk Driving?
Wrongful Death Caused By a Drunk or Impaired Driver
It is a sad reality that drunk drivers often cause fatal accidents. The Insurance Information Institute reports that 30% of all crash-related fatalities involved alcohol-impaired drivers. According to the National Highway Traffic Safety Administration (NHTSA), over the 10-year period from 2012-2021, about 10,850 people died every year in drunk-driving crashes.
These statistics are alarming for all drivers. We all share the roads in Las Vegas and drunk drivers present the same risk to all the people in our community. Even for the people who are lucky enough to walk away from a car crash with a drunk driver with only minor injuries, it can have a serious effect on their daily life – making every trip on our roadways a distressing experience. Of course, when someone is severely injured or killed by a drunk driver, the effects are devastating and life-altering.
