If the police have not arrived, call the police immediately and report your suspicions to the dispatcher.
In addition to informing the police that you believe the other driver is under the influence, there are several other important steps to follow at the scene of any crash to protect yourself and the other people involved.

What Are Nevada’s Laws on Drunk Driving?
In Nevada, the legal blood and alcohol, or BAC, limit for drivers over the age of twenty-one is 0.08%. This limit drops down to 0.04% for commercial drivers and, even further, to 0.02% for those drivers under twenty-one.
Driving with a BAC that is over the limit is considered illegal per se in Nevada. Sometimes an impaired driver can be below the legal limit and still be considered too intoxicated to legally drive under Nevada law. If the responding officer determines that the other driver was under the influence of alcohol and/or drugs and, despite being under the legal limit was still not able to safely operate their vehicle, they may still be convicted of DUI. This is true whether the driver was DWI, high, drugged, stoned, impaired, buzzed, or otherwise distracted – like when texting and driving.
If a drunk driver was being served alcohol by a business, such as a bar, before they caused an accident, many states allow the people who were hurt to pursue a claim against the business as well as the drunk person. These laws, the ones that allow the injured party to recover from the business, are referred to as Nevada dram shop laws.
Unfortunately, Nevada has a law that effectively says the opposite. Under Nevada’s law, the injured person generally cannot recover for their damages/injuries from the business that served the alcohol.
More specifically, Nevada’s law, NRS 41.1305, states that a business that serves alcohol to a “person who is 21 years of age or older is not liable in a civil action for any damages caused by the person to whom the alcoholic beverage was served . . . .” Nevada’s law does have an exception for circumstances in which the alcohol was served to an underage person, someone under 21 years of age. However, even this exception has limitations.
If you were hit by a drunk driver, you need an experienced injury firm to ensure you recover from all responsible parties. While Nevada’s laws restrict our ability to hold businesses responsible, your case may fall into one of the exceptions. If you were hurt by someone driving under the influence and have questions regarding who may be held responsible, give us a call today – the consultation is always free.
Sometimes when a person (or business) hurts or injures someone else, their behavior was so egregious that the law allows the injured person to recover additional compensation in order to punish the business and/or person who caused the injuries. These are called punitive damages. More specifically, punitive damages are monetary awards meant to punish wrongdoers who, among other things, engaged in acts disregarding the safety of others.
Nevada law allows people who were injured by a drunk driver to recover punitive damages. As NRS 42.010 states, people injured by a drunk driver “may recover damages for the sake of example and by way of punishing the defendant.”

“Amazing results! The best in Las Vegas! I was rear-ended by a drunk driver at a red light. I was hesitant to seek legal representation. It became apparent in the week following my accident that my pain was increasing and I had multiple injuries. It was difficult to get doctors’ offices to even see me once they heard that it was a motor vehicle accident. The auto insurance company offered me a trivial amount of money that I knew wasn’t even going to cover my copays for the treatment I would need. My friend encouraged me to call Shawn & it was the best decision I could have made. Shawn and his team helped me get the medical care I needed. They walked me through every step of the process with patience and respect. I will be sending my friends and family to Shawn. Call him. You will be glad you did.”
