Lyft & Uber Accident Injuries
When accidents occur involving Uber or Lyft rideshare vehicles, the same laws apply as in any other motor vehicle accident. In other words, liability falls on the party whose negligence caused the accident. If the crash was caused by the Uber or Lyft driver’s negligence, they will be held responsible. Nevada’s Rideshare Insurance Requirements
In Nevada, Uber is required to carry $1.5 million in auto liability insurance when a passenger is in the vehicle. However, if the driver is logged into the app but not actively transporting a passenger, the coverage is reduced to $50,000.
There was also a proposed bill, SB125, in 2023 that, had it passed, would have increased the level of protection for rideshare passengers. This bill aimed to designate rideshare services as "common carriers," similar to taxis, requiring Uber and Lyft to adhere to a higher level of passenger safety. Unfortunately, the bill did not gain enough votes to pass in April 2023.
Common Carrier Designation and Legal Responsibility
Nevada’s Chapter 706, which regulates motor carriers, requires common carriers (like taxis) to take extra precautions to ensure the safety of their passengers. If Uber and Lyft had been classified as common carriers, they would have been required to provide a higher standard of care. As it stands, rideshare companies and their drivers must act as “a very cautious, competent, and prudent person would” under similar circumstances. This means that if a rideshare driver fails to drive carefully, they could be held partially liable for injuries caused to passengers.
Additionally, Uber and Lyft drivers must ensure safety when picking up or dropping off passengers. If a passenger is injured while entering or exiting the vehicle, the driver could be held liable for those injuries as well.
